香港欖球總會條款及細則
1. 釋義:
1.1. 「欖總」:香港欖球總會。一間在香港註冊成立的公司,註冊辦事處位於香港銅鑼灣掃桿埔大球場徑1號奧運大樓2001室
1.2. 「活動」:香港欖球總會舉辦的單個或多個活動
1.3. 「場地」:活動舉行的場所
1.4. 「門票」:活動的門票
1.5. 「客戶」:透過本網站購買門票的人士
1.6. 「賓客」:因受到客戶邀請而從門票獲益的人士


2. 持票人士須遵守以下條款及細則:

1. 入場人士必須遵守《體育場規例》 (香港特別行政區法例第132章附屬法例(BY)) 及「使用香港大球場及旺角大球場舉辦本地及國際體育賽事的條款及守則」。詳情請瀏覽 https://www.elegislation.gov.hk/hk/cap132BY及http://www.lcsd.gov.hk/tc/rule.html。入場人士亦必須注意:(i) 留意並遵從《中華人民共和國香港特別行政區維護國家安全法》和與維護國家安全有關的香港其他法律(以下簡稱「國安法」),並確保在大球場內的行為或活動不會可能構成或可能導致在國安法或香港其他法律下屬危害國家安全,或不利於國家安全的罪行。
(ii) 不得作任何未獲認可的商業或其他的廣告宣傳,亦不得於旗幟、橫額、衣物、運動服或配飾上,或概括而言,在觀眾、運動員或其他入場人士所穿戴或使用的任何物件或器材上,展示任何政治、種族主義或挑釁性宣傳。然而,如作為識別有關物品或器材生產商的標記而並非處於當眼位置以作宣傳用途者,則此項規定並不適用。
2. 根據2022年10月21日公告,所有入場人士均須出示在活動當天的快速抗源測試(RAT測試)陰性結果證明,否則將不能進入大球場。入場人士必須㩦同標示姓名及測試日期及時間的快速抗源測試(RAT測試)測試棒相片,大球場入口處的工作人員將作檢查。
3. 持票人須提供比賽日門票的購票證明及向衛生防護中心的「2019冠狀病毒快速抗原測試陽性結果人士申報系統」申報證明,香港欖球總會將就持票人無法參加的日子進行退款。
4. 香港欖球總會(欖總)及香港大球場場地管理人員將保留權利拒絕任何人士進場。
5. 任何人攜帶未經許可的物品會被禁止進場,未經許可的物品包括但不限於塑料、玻璃、金屬罐或瓶,不論該罐或瓶是空的或是載有任何東西的、任何載有令人醺醉的酒類的東西、任何球類、任何模仿紀律部隊制服或裝備的物品、任何危險物品、帶有歧視、政治含意的物品、任何機械或非機械性操作的發聲工具、任何遙控飛行裝置或玩具,以及欖總和場地管理人員斷定為不適合進場的物品。有關未經許可的物品的完整列表,請瀏覽網址 www.hksevens.com/prohibiteditems
6. 為確保公眾安全,場地保安人員有權檢查入場人士的隨身物件。
7. 服飾必須合宜,不可佔用超過一個座位或對觀眾視線構成或可能構成阻礙。禁止佩戴類似武器或具攻擊性的飾品。
8. 嚴禁拋擲物件、使用粗言穢語及作出擾亂秩序的行為。
9. 未經香港欖球總會或場地管理人員許可,不得於場內展示旗幟、橫額、海報、彩旗、宣傳單張或任何形式之廣告或展示品。
10. 為保障公眾安全,禁止攜帶啤酒或含酒精飲品進入高層看台的座位區,場地保安人員有權檢查進入高層看台座位區人士的隨身物件。
11. 除獲活動主辦單位或場地管理人員准許,任何人士不可進入草地球場範圍。未經授權者進入草地球場範圍將被起訴。
12. 香港欖球總會及場地管理人員有權驅逐任何不遵守大球場條例及守則的人士離場。
13. 持票人須自行負責保管電子門票。
14. 欲重新進入大球場,須出示有效的電子門票。
15. 參與賽事期間,在法律許可的範圍下,如蒙任何財物損毀或遺失、個人損傷或任何法律責任,香港欖球總會一概毋須負責。不論此等損壞、損失或損傷是否由疏忽或其他原因所致,持票人須負全責。香港欖球總會及其員工,以及國泰航空/匯豐香港國際七人欖球賽2022的承辦商均受豁免和免除責任。
16. 場內拍攝所得的相片及錄像不能作任何商業用途。禁止以任何媒體出版或分發有關相片及錄像。同樣,製作或發布任何廣播、評論、新聞報導或作統計用途(以任何媒體或格式作為工具,包括任何手提電話及或其他無線裝置)均被禁止。
17. 持票人(i)接受並且同意其肖像於場內廣播或作其他商業用途,以及(ii) 同意不可撤銷的放棄審閱或檢查以任何媒體廣播或使用其肖像。
18. 未經主辦單位同意及批准,持票人士不得以物件霸佔座位,香港欖球總會及場地管理人員會移走有關物件而不作另行通知。
19. 門票持有人同意不參與及從事任何侵犯與國泰航空/匯豐香港國際七人欖球賽2022具商業關連的埋伏營銷活動。
20. 2022年11月4日當日﹐兩歲或以下幼兒,可由一位持成人票的成人攜同免費入場。
21.2022年11月4日當日﹐12歲或以下兒童可憑兒童票入場。
22. 如果主辦單位沒有進行任何一天的比賽,持票人可全額退還當天門票的票面價值。賽事是否進行將由主辦單位賽事總監作最終決定。

 

3. 退款
3.1. 如活動被取消或活動期間並無舉辦賽事,客戶將獲退款。退款金額等於門票價格減退款手續費,而購買門票時已支付的訂票費將不獲退還。賽事是否進行將由主辦單位賽事總監作最終決定。

4. 責任限制
4.1. 該等條款及細則内概無免除或限制欖總及/或其各自員工、代理或分包商(或任何其他人士)由於自身疏忽所造成的個人傷亡或對欺詐或不實陳述而承擔的責任,或法律規定無法免除或限制的任何其他責任。

5. 彌償保證
5.1. 客戶將就違反條款4内所載的義務,或任何其他由於客戶或其賓客的任何行為或疏漏造成的個人傷亡,所引致的一切直接及間接的訴訟、法律程序、負債、損害、損失、申索及成本、開支、要求以及因合約、民事索償或其他方式所產生的法律程序,對欖總、場地擁有人或營運商及其各自員工、代理及分包商作出彌償及持續彌償。

6. 個人資料
6.1. 客戶承認及同意欖總搜集其提供的個人資料並將該等個人資料存放於欖總所持有的資料庫内。客戶特此同意該等資料用於活動組織及營運(尤其是活動票務等相關銷售行為以及任何活動相關的安全及安保措施),並保證其已就該條款徵得賓客同意。欖總將獲准出於以上目的,向包括其代理在内的第三方傳送該等個人資料(如適用)。此外,該等個人資料可用作向客戶提供欖總產品、服務、商業活動及其他活動資訊。

7. 本條款及細則的中、英文版如有任何差異,所有條款均以英文版本為準。

1. Definitions:

1.1. “HKRU”: Hong Kong Rugby Union. A company incorporated in Hong Kong with its registered office at Olympic House, Room 2001, 1 Stadium Path, So Kon Po, Causeway Bay, Hong Kong

1.2. “Event”: the individual event or events organized by the Hong Kong Rugby Union

1.3. “Venue”: the venue at which the Event is taking place

1.4. “Tickets”: Tickets to the Event

1.5. “Client”: the individual purchasing tickets using this website

1.6. “Guest”: each person who receives the benefit of a Ticket as a result of an invitation from the Client

 

2. Acceptance of Terms

2.1 By agreeing to purchase the Tickets and attending the Event, the Client will be deemed to have accepted and agreed all the terms.

2.2 Spectators must comply with the Stadia Regulation (Cap.132 sub. leg. (BY)) of the laws of the Hong Kong Special Administrative Region and the “Terms and Conditions of Use of Hong Kong Stadium for Major Local and International Sporting Events”. For details, please visit https://www.elegislation.gov.hk/hk/cap132BY and http://www.lcsd.gov.hk/en/rule.html. Specific attention for all spectators must:

i. Observe and comply with the Law of the People’s Republic of China on Safeguarding National Security in the Hong Kong Special Administrative Region and other relevant laws of Hong Kong in relation to the safeguarding of national security (“National Security Law”); and ensure that no act or activity which is likely to constitute or is likely to cause the occurrence of an offence endangering national security under the National Security Law or other laws of Hong Kong, or which would otherwise be contrary to the interests of national security, is engaged in the Stadium.

ii. any form of unauthorized publicity, commercial or otherwise, political propaganda, racist or provocative messages appearing on flags, banners, clothing, sportswear, accessories or, more generally, on any article or equipment whatsoever worn or used by spectators, athletes or other participants in the Events is not permitted. However, this shall not apply to the identification of the manufacturer appearing on such clothing, article or equipment concerned, provided that such identification is not marked conspicuously for the purposes of advertising.

2.3 The right of admission is reserved by the Hong Kong Rugby Union (HKRU) and the Management of Hong Kong Stadium (Stadium Management).

2.4 Any person found with prohibited items may be denied of entry into the Stadium. Prohibited items include but not limited to plastic, glass, metal cans or bottles, anything containing intoxicating liquor, any balls, any items simulating the uniform or equipment of the disciplined services, any dangerous items, any discriminatory and political display items, any noise instruments, any remote-controlled flying devices or toys, or any other item deemed inappropriate by HKRU and the Stadium Management. 2.5 To ensure public safety, the Stadium’s security staff have the authority to inspect the personal belongings of spectators entering the Stadium.

2.6 Any costume must conform to reasonable standards of decency and should not take up more space than one seat or obstruct the full view of other spectators. Accessories that look like usable weapons are not permitted.

2.7 Throwing objects, foul language and behaving in a disorderly manner in the Stadium is prohibited.

2.8 No flags, banners, buntings, posters, flyers, leaflets, and/or publicity, promotional, propaganda and display materials of any kind may be displayed in the Stadium without the permission of the HKRU or the Stadium Management.

2.9 For the sake of public safety, no beer and alcoholic beverage shall be brought into the seating areas of the Upper Levels. Stadium’s security staff have the authority to inspect the personal belongings of spectators entering the seating areas.

2.10 No unauthorized persons shall enter the turf pitch level unless so directed by an Event or Stadium staff. Persons entering the turf pitch level without authorization will be prosecuted.

2.11 The HKRU and Stadium Management reserve the right to remove any person from the Stadium who fails to comply with an instruction from an Event or Stadium staff.

2.12 Ticket holder shall be responsible for the safekeeping of their digital ticket.

2.13 Re-entry into the Stadium is allowed only with a valid digital ticket.

2.14 Ticket holder agrees not to bring any claim or proceeding against the HKRU for any damage, loss, injury or liability suffered while attending the Tournament, except for liability that by law cannot be excluded. The HKRU excludes all liability to the holder in tort (including negligence), contract or ailment for acts or omissions of the HKRU, its employees and contractors arising out of or in relation to the Cathay/HSBC Hong Kong Sevens 2023.

2.15 Photographs taken and video shooting within the venue may be used only for private non-commercial purposes. Publication/distribution of such photographs or videos in any media is forbidden. Making/distribution of broadcasts, commentary, news reports or statistics (by any means in any format or media including any such commentary made by mobile phone or other wireless device) is forbidden.

2.16 Ticket holder (i) consents to the broadcasting or other distribution of images of him/herself whilst at the venue and (ii) waives on an irrevocable worldwide, perpetual basis all rights to object to such broadcasting/distribution in any media.

2.17 Without the permission of the HKRU or the Stadium Management, ticket holders are not allowed to occupy seats with personal belongings, which will be removed by Event or Stadium staff without prior notice.

2.18 Ticket holder agrees not to engage in any ambush marketing that would infringe the rights of those parties commercially associated with the match and/or the Cathay/HSBC Hong Kong Sevens 2023.

2.19 A child aged 2 and under on the 31st March 2023 may enter the Stadium free of charge when accompanied by an adult with an adult ticket.

2.20 A child aged 12 and under on the 31st March 2023 is allowed to enter the Stadium with a child ticket.

2.21 If no play takes place for the duration of the day, the ticket holder is entitled to a full refund of the face value of the ticket for that day. Whether play takes place will be decided by the tournament director and their decision shall be final.

 

3. Refund

 

3.1. In cases where the Event is cancelled or no play takes place for the duration of the event session, the Client will receive a refund. The amount refunded will be the full ticket price less a refund handling fee and the booking fee paid at the point of purchase will be non-refundable. Whether play takes place will be decided by HKRU and their decision shall be final.

 

4. Limitation of Liability

4.1. Nothing in these Terms and Conditions excludes or limits the liability of HKRU, and/or their respective employees, agents or sub-contractors (or any other person) for death or personal injury caused by their own negligence, for fraud or fraudulent misrepresentation or for any other liability that cannot be excluded or limited by law.

 

5. Indemnity

5.1. The Client will indemnify, and keep indemnified the HKRU, the owners or operators of the Venue and their respective employees, agents and sub-contractor against all direct and indirect actions, proceedings, liabilities, damages, losses, claims and costs, expenses, demands and proceedings whatsoever arising whether in contract, tort or otherwise, arising out of or in connection with a breach of its obligations in Condition 4, or any other personal injury or damage to property caused by any act or omission of the Client or its Guests.

 

6. Personal Data

6.1. The Client acknowledges and agrees that the personal data provided by the Client on the site are collected by HKRU and will be entered into a database owned by HKRU. The Client hereby consents to such personal data being used for the purposes of the organisation and running of the Event (in particular in connection with the sale of the Event and any relevant safety and security measures in respect of the Event), and warrants that it has obtained the consent of its Guests in relation to the same. HKRU shall be permitted to transfer such personal data to third parties, including, if appropriate, their respective agents, for the purposes set out above. Furthermore, such personal data can be used to provide the Client with information on products, services, commercial activities, and events of HKRU.

7. In the event that there is inconsistency between the English and Chinese versions of these terms and conditions, the English version shall prevail.
